§1 Acceptance of Terms
Welcome to Fishlanthropy Foundation, Inc. (“Fishlanthropy,” “the Foundation,” “we,” “us,” or “our”).
These Terms of Service (“Terms”) govern your access to and use of the Foundation’s website, content, donation features, charitable programs, and any related materials made available by the Foundation (collectively, the “Services”).
By accessing, viewing, donating to, submitting information to, or otherwise using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you should not use the Services.
These Terms apply to all visitors, donors, applicants for assistance, and other users of the Services.
If you are accessing or using the Services on behalf of an organization or entity, you represent and warrant that you have the authority to bind that organization to these Terms.
We may update these Terms from time to time. Continued use of the Services after any changes become effective constitutes acceptance of the revised Terms.
§2 – Purpose & Scope
Fishlanthropy Foundation, Inc. is an Ohio nonprofit corporation organized and operated exclusively for charitable and educational purposes within the meaning of Section 501(c)(3) of the Internal Revenue Code.
The Foundation’s Services are provided solely to:

share information about the Foundation’s mission and charitable programs;

accept voluntary donations;

allow individuals or organizations to submit requests or applications for charitable assistance;

provide educational content related to community aid and philanthropy; and
-
facilitate non-binding community input or voting regarding charitable initiatives, where offered.
The Foundation does not operate a commercial marketplace, provide escrow services, process payments on behalf of users, resolve disputes, or offer professional, financial, or legal services.
Any references to third-party platforms, technologies, or affiliated organizations are provided for informational purposes only and do not create a partnership, agency, or operational control relationship.
Use of the Services is limited to the purposes described in this section. Any use outside the intended charitable and informational scope is prohibited.
§3 – Eligibility
Use of the Foundation’s Services is limited to individuals and entities that are legally eligible to participate in charitable, educational, or informational activities under applicable law.
By accessing or using the Services, you represent and warrant that:

you are at least eighteen (18) years of age, or are using the Services with the consent and supervision of a legal guardian;

you have the legal capacity to agree to these Terms;

your use of the Services complies with all applicable federal, state, and local laws; and
-
any information you submit to the Foundation is truthful, accurate, and not misleading.
The Foundation reserves the right, in its sole discretion, to restrict or deny access to the Services to any person or entity that:

violates these Terms;

provides false or misleading information;

attempts to misuse charitable programs, donation mechanisms, or community voting features; or
-
engages in conduct that is harmful to the Foundation, its mission, or the communities it serves.
Eligibility for charitable assistance, grants, awards, or recognition programs is determined separately and may be subject to additional criteria, verification, or documentation, as described in applicable program guidelines.
§4 – Donations
By making a donation to Fishlanthropy Foundation, you acknowledge and agree to the following terms:

Voluntary Contributions
All donations are voluntary and made without expectation of goods, services, refunds, or guaranteed outcomes. -
No Earmarking Guarantee
While donors and community members may be able to express preferences, vote, or provide input regarding charitable causes or recipients, all donations are ultimately controlled and allocated at the discretion of the Foundation, consistent with its charitable mission and applicable law. -
Irrevocability of Donations
Donations are final and non-refundable, except where required by law or expressly approved by the Foundation in writing. -
Tax Treatment
Donors are responsible for determining the tax deductibility of any contribution. The Foundation does not provide tax advice and makes no guarantees regarding deductibility. -
Methods of Donation
Donations may be made through supported payment methods, including digital wallets or blockchain-based transfers. Donors are solely responsible for ensuring accuracy of payment details and wallet addresses. -
Use of Technology
Donations may be processed, recorded, or displayed using blockchain or other automated systems for transparency purposes. Such systems are provided “as is” and may be subject to technical limitations. -
Compliance
The Foundation reserves the right to refuse, restrict, or return any donation that it reasonably believes violates applicable law, regulations, sanctions, or internal policies.
§5 – Use & Allocation of Funds

Charitable Purpose Only
All funds received by Fishlanthropy Foundation shall be used exclusively for charitable and educational purposes consistent with the Foundation’s mission and applicable law. -
Board Discretion
The Foundation’s Board of Directors retains final authority over how funds are allocated, distributed, or reserved, regardless of community input, voting outcomes, or recommendations. -
Program Categories
Funds may be allocated to one or more of the following, at the Foundation’s discretion:-
Direct assistance to individuals or families in need

Grants or donations to qualifying charitable causes or organizations

Community-selected initiatives

Prize pools, recognition awards, or incentive programs

Operational costs necessary to administer charitable programs

No Guaranteed Outcomes
Participation in voting, submissions, or community activities does not guarantee that any specific individual, cause, or submission will receive funding. -
Timing of Distributions
Distributions may occur on a rolling, periodic, or discretionary basis. The Foundation is not obligated to distribute all funds immediately and may reserve funds for future charitable use. -
Administrative Costs
A reasonable portion of funds may be used for administrative, compliance, technology, security, and operational expenses necessary to support the Foundation’s programs. -
Transparency
The Foundation may publicly disclose aggregate funding activity, distributions, or wallet-level transaction data for transparency, while preserving privacy where required.
§6 – Submissions for Assistance

Voluntary Submissions
Individuals or third parties may submit requests for charitable assistance (“Submissions”) through tools, forms, or interfaces made available by the Foundation or its partners. -
No Guarantee of Review or Funding
Submission of a request does not guarantee review, selection, advancement, funding, or response. The Foundation may limit, pause, reject, or remove submissions at any time. -
Accuracy and Truthfulness
By submitting a request, the submitter represents that all information provided is accurate, truthful, and not misleading. False, deceptive, or fraudulent submissions may result in disqualification or removal. -
Eligibility Requirements
The Foundation may impose eligibility requirements, verification steps, or category limitations for submissions, including but not limited to residency, need type, documentation, or timing. -
Public Visibility
Submissions may be displayed publicly, partially, or anonymously for purposes of community review, voting, or feedback. The Foundation does not guarantee privacy or confidentiality for submitted content. -
Removal and Moderation
The Foundation reserves the right to moderate, edit, flag, or remove submissions that violate these Terms, applicable policies, or community standards. -
No Professional Advice
The Foundation does not provide legal, financial, medical, or professional advice and does not verify the legitimacy of submissions beyond its own internal processes. -
Third-Party Links and Contact
Submissions may include links or references to third-party platforms or contact methods. The Foundation is not responsible for interactions occurring outside its systems.
§7 – Community Input & Voting

Community Participation
The Foundation may allow members of the community to provide input, recommendations, or votes regarding charitable initiatives, assistance submissions, or fund allocations. -
Advisory Nature of Voting
All voting, polling, or ranking mechanisms are advisory only. Community input does not create any entitlement, guarantee, or enforceable right to receive funds or assistance. -
Eligibility to Participate
The Foundation may limit voting or input participation based on criteria such as account status, platform activity, digital credentials, or other eligibility requirements. -
Voting Mechanics
Voting systems may include ranking, comparisons, randomized pairings, point-based systems, or other methods. The structure, frequency, and duration of voting periods are determined solely by the Foundation. -
Final Decision Authority
The Foundation retains sole discretion over all charitable distributions and may consider community input alongside other factors, including available funds, verification results, and charitable priorities. -
Fraud Prevention and Abuse
The Foundation may restrict, suspend, or invalidate votes or input suspected of manipulation, automation, collusion, or abuse. -
No Compensation or Consideration
Participation in voting or community input activities does not constitute employment, agency, or compensated service. -
Changes and Suspension
The Foundation may modify, suspend, or discontinue any community input or voting feature at any time without notice.
§8 – Prizes, Awards & Recognition

Purpose of Awards
The Foundation may provide prizes, awards, or recognition to acknowledge community participation, service, or contribution to charitable objectives, including participation in dispute-resolution activities, community voting, or educational initiatives. -
No Employment or Compensation
Prizes and awards are not compensation for services, do not create an employment, contractor, or agency relationship, and are not wages or fees for labor. -
Eligibility
Eligibility for prizes or awards may be based on participation criteria, activity thresholds, eligibility rules, or other requirements determined by the Foundation. -
Selection Methods
Awards may be distributed using merit-based evaluation, randomized selection, or hybrid methods. Selection mechanisms may include automated or verifiable random processes. -
No Guaranteed Awards
Participation in Foundation activities does not guarantee receipt of any prize or award. Availability and amounts depend on funding, participation levels, and program structure. -
Tax Responsibility
Recipients are solely responsible for any applicable taxes, reporting obligations, or disclosures associated with receiving prizes or awards. The Foundation may issue required tax documentation when applicable. -
Modification or Discontinuation
The Foundation reserves the right to modify, suspend, or discontinue any prize or award program at any time. -
Fraud and Abuse
The Foundation may withhold, revoke, or recover prizes or awards in cases of fraud, misrepresentation, or violation of Foundation policies.
§9 – Intellectual Property & User Content

Foundation Content
All content created or published by the Foundation, including text, graphics, logos, documentation, and program materials, is owned by or licensed to the Foundation and may not be copied, modified, or redistributed without permission. -
User Submissions
Any content submitted to the Foundation, including videos, written statements, images, or other materials, remains the property of the submitting individual unless otherwise stated. -
License to Use Submissions
By submitting content, users grant the Foundation a non-exclusive, royalty-free, worldwide license to review, display, store, reproduce, and distribute the content solely for purposes related to Foundation programs, voting, transparency, education, and charitable operations. -
No Commercial Exploitation
The Foundation does not sell or commercially exploit user-submitted content. -
Public Visibility
Some submissions may be publicly visible as part of community review, voting, or transparency processes. Users should not submit content they do not wish to be viewed publicly. -
Content Standards
Submissions must not include illegal material, misleading information, explicit sexual content, or content intended to deceive, harass, or exploit others. -
Right to Remove Content
The Foundation reserves the right to remove or restrict access to any content that violates these Terms or Foundation policies. -
No Endorsement
Publication or display of user content does not imply endorsement by the Foundation.
§10 – Disclaimers & Limitation of Liability

Charitable Nature of Programs
The Foundation provides charitable programs, community voting tools, and educational resources on an “as-is” and “as-available” basis. -
No Guarantee of Assistance
Submission of a request, participation in voting, or community interest does not guarantee financial assistance, selection, or payout. -
No Professional Advice
The Foundation does not provide legal, financial, medical, or professional advice. Users are responsible for their own decisions and actions. -
Third-Party Platforms
The Foundation may rely on third-party platforms, payment rails, blockchain networks, or technical services. The Foundation is not responsible for outages, delays, or failures caused by third parties. -
Limitation of Liability
To the fullest extent permitted by law, the Foundation shall not be liable for any indirect, incidental, consequential, or special damages arising from participation in Foundation programs. -
Maximum Liability
The Foundation’s total liability, if any, shall not exceed the amount of funds directly distributed to the affected user through the Foundation during the applicable program period. -
User Responsibility
Users are solely responsible for the accuracy of information submitted and for compliance with applicable laws.
§11 – Governing Law & Dispute Resolution

Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Ohio, without regard to conflict-of-law principles. -
Good-Faith Resolution
Users agree to attempt to resolve any concerns related to Foundation programs through good-faith communication before pursuing any formal action. -
No Arbitration Requirement
The Foundation does not require binding arbitration for disputes related to charitable participation. -
Jurisdiction
Any legal action arising from these Terms shall be brought in a court of competent jurisdiction located in Ohio, unless otherwise required by law. -
Equitable Relief
The Foundation reserves the right to seek equitable or injunctive relief to protect its charitable mission, integrity, or community from misuse or abuse.
§12 – Amendments & Contact Information

Updates to Terms
The Foundation may update these Terms from time to time to reflect changes in programs, legal requirements, or operational practices. -
Effective Date of Changes
Updates become effective upon publication within the Foundation’s Legal or Help Center unless otherwise stated. -
Continued Participation
Continued use of Foundation programs after changes are posted constitutes acceptance of the updated Terms. -
Severability
If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect. -
