§12 Changes to Terms

12.1 Right to Modify

Fisheez PBC may revise, update, or replace these Terms at any time to reflect changes in law, smart-contract architecture, product functionality, or business operations.

Revised Terms become effective upon posting to the Platform or official website, unless a later effective date is specified.

By continuing to access or use the Platform after the effective date, users agree to the updated Terms and acknowledge that continued use constitutes binding acceptance.

12.2 Notice of Material Changes

For any change that materially affects user rights or obligations—such as modifications to fees, dispute procedures, enforcement systems, or data policies—Fisheez PBC will provide reasonable advance notice through one or more of the following:

• an in-Platform banner or pop-up alert;
• email to the registered address on file; or
• a public post on the official Fisheez website or verified social channels.

Users who do not agree to the revised Terms must stop using the Platform before the effective date.

Continuing to transact or access the Platform after notice constitutes full acceptance of the updated Terms.

12.3 Smart-Contract and Protocol Updates

Because Fisheez operates using non-custodial smart contracts and is not a money transmitter or financial intermediary, system upgrades may be deployed to preserve performance, compliance, or user security.

Smart-contract or protocol updates:

• do not retroactively alter rights or obligations for completed transactions;
• may adjust future logic, fee routing, or distribution mechanics to reflect operational or legal changes; and
• are automatically incorporated into these Terms once a new version is published with an identifiable contract address and version number.

Users are responsible for confirming that they interact only with official, verified Fisheez smart contracts posted on the official site or repositories.

12.4 Version Control and Transparency

Each update to these Terms will display a clear Effective Date and Version Number at the top of the document.

Fisheez PBC will maintain a public archive of all prior versions for transparency, compliance, and regulatory reference.

12.5 Continuing Use and Platform Modifications

If any portion of the Platform, smart contract, or service layer is updated, suspended, or deprecated, existing transactions will continue to execute under the version of the Smart Shell contract in effect at initiation.

Use of any new or modified features after the effective date of an update constitutes acceptance of the revised Terms.

12.6 No Retroactive Waiver

No amendment, revision, or replacement of these Terms waives or limits rights or obligations that have already accrued under earlier versions, unless explicitly stated in writing and published by Fisheez PBC.
