Prohibited Items & Restricted Categories Policy

1. Purpose & Scope
This Policy identifies items, services, and digital assets that cannot be listed or sold on Fisheez, as well as categories requiring additional verification or limitations.
This Policy is incorporated into:
- Fisheez Terms of Service
- SmartShell Escrow Agreement
- Seller Agreement
- Listing Rules Policy
- §10 Category-Specific Provisions
2. Fully Prohibited Items (No Exceptions)
The following may not be sold under any circumstances:
2.1 Illegal Items
- Stolen goods
- Counterfeit goods
- Unlicensed replicas
- Items violating local, state, or federal law
2.2 Weapons & Hazardous Materials
- Firearms
- Ammunition
- Explosives
- Fireworks
- Hazardous chemicals
- Military-grade equipment
2.3 Drugs & Controlled Substances
- Illegal drugs
- Prescription medications
- Drug paraphernalia
2.4 Adult Content
- Pornography
- Explicit adult services
- Escort services
2.5 Financial Products
- Securities or investment contracts
- Profit-sharing agreements
- Tokens or coins treated as securities
- Investment advice services
- “Flipping services” for money or crypto
2.6 Gambling
- Raffles
- Lotteries
- Betting pools
2.7 Animals
- Live animals
- Breeding services
- Animal transport services
2.8 Digital Misconduct
- Hacking tools
- Malware
- Cracked software
- Keygens
- Unauthorized digital access
3. Restricted Categories (Allowed Only Under §10 Rules)
These categories may be listed only if the Seller meets requirements in TOS §10:
3.1 High-Value Collectibles
Requires:
- Accurate condition grading
- Authenticity disclosures
- Proof of ownership
3.2 Automotive & Powersports Parts
Requires:
- VIN disclosure (where applicable)
- Accurate fit/compatibility
3.3 Electronics
Requires:
- Disclosure of activation locks
- Battery condition
- Missing accessories
3.4 Digital Services
Requires:
- Clear milestone definition
- Transparent deliverables
- No speculative financial services
3.5 Physical Services
Requires:
- Clear scope of work
- Local law compliance
- No regulated labor categories (unless legally certified)
3.6 Local/In-Person Trades
Requires:
- Safe meeting locations
- Verification procedures (future QR-based system is allowed post-MVP)
3.7 Goods That Require Condition Verification
Examples:
- Luxury handbags
- Jewelry
- Watches
- Graded cards
Seller must follow §10 verification rules.
4. NFT, Crypto & Smart Contract Restrictions
Allowed:
- NFT collectibles (TideTurners, Shorefront NFTs)
- Utility NFTs
- Digital art
- Non-financial tokenized items
Prohibited:
- Investment tokens
- Yield-bearing digital assets
- Token airdrops promising financial gain
- Tokenized debt or securities

5. Enforcement & Penalties
Violations may result in:
- Listing removal
- Category restrictions
- Loss of selling privileges
- Account suspension or termination
- Escalation to dispute review or platform safety review
Penalties align with TOS §6 User Conduct and §10 Category-Specific Provisions.
