§3 Account Security and Responsibilities

3.3.1 User Responsibility for Credentials

Users are solely responsible for maintaining the confidentiality of their account credentials, passwords, authentication codes, and connected wallet keys.

Fisheez PBC does not have access to private wallet keys and cannot restore, reverse, or recover funds lost through user error, compromised devices, or unauthorized transactions.

Users agree to:

Maintain secure control over all login credentials and wallet authorizations;

Use strong, unique passwords and updated security methods (e.g., two-factor authentication where available);

Keep software wallets, browsers, and devices current with security patches; and

Immediately notify Fisheez PBC if they suspect any unauthorized use or breach of their account.

3.3.2 Wallet Connection and Digital Signatures

All blockchain-based actions (such as minting, purchasing, listing, or dispute participation) require the user to digitally sign transactions using their connected wallet.

By signing a transaction, the user authorizes the action recorded on-chain and acknowledges that such authorization is final, irreversible, and non-refundable once broadcast to the blockchain.

Users are responsible for verifying the accuracy of all transaction details—including recipient addresses, prices, and fees—before confirming any on-chain signature.

3.3.3 Shared or Business Accounts

Where a business, organization, or team operates through a shared account, the entity must designate a single authorized representative.

That representative assumes full responsibility for the account and for the actions of all affiliated personnel using it.

Fisheez PBC may require additional verification or documentation for such accounts.

3.3.4 Unauthorized Access and Breach Procedures

If Fisheez PBC reasonably believes an account has been compromised, it may temporarily suspend activity, freeze transactions, or disable wallet connections to protect users and platform integrity.

Fisheez will make reasonable efforts to notify the affected user at the registered email or phone number.

The Platform may require additional verification before restoring access.

Fisheez PBC is not liable for losses resulting from delays, freezes, or protective actions taken in good faith.

3.3.5 Third-Party Integrations and Linked Services

Users may connect third-party tools or services (such as payment providers, marketplaces, or analytics tools) to their Fisheez account at their own discretion.

Fisheez PBC is not responsible for the security, functionality, or data handling of any external service.

Connecting or authorizing third-party tools is at the user’s own risk, and those relationships are governed by the third party’s terms of service and privacy policies.

3.3.6 Device and Network Security

Users are responsible for maintaining secure access to the devices and internet connections used to access the Platform.

Fisheez PBC does not guarantee continuous, uninterrupted, or virus-free operation and is not responsible for losses arising from malware, phishing, or other user-side vulnerabilities.

3.3.7 Account Integrity and Misuse

Users agree not to:

Use another person’s account or wallet without authorization;

Circumvent security measures, rate limits, or access controls;

Attempt to probe, scan, or test the vulnerability of the Platform; or

Interfere with any other user’s experience or listings.

Violations of these obligations may result in immediate suspension or termination of access, forfeiture of associated NFTs, and potential referral to legal authorities.

3.3.8 Limitation of Liability

Except where prohibited by law, Fisheez PBC is not liable for:

Lost or stolen private keys;

Erroneous transactions, including mis-sent payments or NFTs;

Hacks, phishing, or malware originating outside of the Platform;

Downtime, maintenance, or system interruptions; or

Unauthorized actions taken using valid user credentials.

All transactions confirmed on-chain are final and irreversible.

3.3.9 User Cooperation

Users agree to cooperate fully with Fisheez PBC in any investigation related to fraud, security breaches, or regulatory compliance, including providing requested documentation or identity confirmation where necessary.
