§14 – Live Events & Streaming Conduct

14.1 Scope
This section governs all live-streamed or interactive sessions (“Live Events”) conducted through the Fisheez Platform, including auctions, demonstrations, performances, classes, service presentations, and community streams.
Live Events enable users to showcase, sell, or discuss goods and services while maintaining legal and community compliance.
Fisheez acts solely as a marketplace facilitator and neutral streaming host.
Hosts are independent users fully responsible for the content, conduct, and results of their Live Events.
14.2 Host Eligibility & Setup
Only verified Sellers, Service Providers, or Promoters may host Live Events.
Hosts must comply with all relevant provisions of these Terms, including §6 (User Conduct) and §10 (Category-Specific Provisions).
Every Live Event must clearly disclose its nature (e.g., auction, tutorial, demonstration, consultation).
All transactions during Live Events must be processed through the Smart Shell Escrow system or another approved on-chain payment method.
Multi-session or recurring Live Events must specify their time frames and expiration terms.
Fisheez may restrict Live Event access or categories based on legal risk, past violations, or performance metrics.
14.3 Content & Conduct Rules
Strictly Prohibited:
Nudity, sexual acts, or explicit adult content.
Hate speech, targeted harassment, or defamation.
Violence, weapons display, or incitement to harm.
Sale or display of controlled substances or unlicensed pharmaceuticals.
Misleading or false claims, including financial or medical promises.
Multi-level marketing, pyramid, or deceptive recruitment models.
Off-platform solicitation, fundraising, or donations without prior approval.
Fraud, counterfeit sales, or off-escrow transactions.
Restricted / Conditional:
Artistic or educational content involving adult themes must include platform age gating and comply with §10.
Coaching or investment education must not promise earnings or guaranteed results.
Auctions or timed offers extending beyond the stream must clearly state closing terms.
Permitted:
Demonstrations, tutorials, performances, and creative sessions.
Service-based events (e.g., design, consulting, teaching) using authorized booking tools.
Transparent, fair-play interactive features compliant with §14.5.
14.4 Viewer Conduct
Viewers must engage respectfully and follow Community Guidelines.
Use of automation, spam, or bot activity to influence results is prohibited.
Viewers acknowledge that Fisheez:
does not control pricing, outcomes, or item availability;
does not guarantee fulfillment or delivery; and
routes all disputes through the Peacemaker System (§7).
14.5 Interactive Features (Giveaways, Wheels, Auctions)
Randomized or Interactive Sales (e.g., spin-the-wheel, grab boxes) are allowed only if:
all participants receive an item or service of equal or disclosed value;
the randomization process is transparent and visible;
each outcome is pre-defined and recorded; and
no participant is required to pay extra for additional spins or advantages.
Free Giveaways are permitted if no purchase or payment is required to enter and selection is fair and visible.
Prohibited: raffles, lotteries, or sweepstakes requiring payment or purchase to participate.
Hosts must disclose that all interactive segments are entertainment only and not gambling.
14.6 Recordings & Content Rights
By hosting or participating in a Live Event, you grant Fisheez PBC a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sublicensable license to record, store, broadcast, reproduce, adapt, distribute, and display your Live Event content, including name, likeness, voice, and visuals (“Live Content”), for purposes such as:
operating and improving the Platform;
replay archives or educational uses;
marketing or promotion of Fisheez; and
compliance verification and dispute resolution.
You understand that:
Fisheez may continue to host or display archived Live Content after account closure;
segments may be used for marketing without additional approval or payment;
you waive any rights of approval, publicity, or moral rights to those uses; and
you retain ownership of your creative work subject to this license.
14.7 Moderation & Reporting
Any viewer may report violations during a Live Event.
Reports must select a violation category and include a written description.
Enforcement depends on matching reports, as defined in the Live Event Moderation Rules:
Level 1 — Behavioral Misconduct
Trigger: 3 matching reports
Result: Warning shown to host; further matching reports may end the event
Possible 24-hour restriction
Level 2 — Prohibited Conduct
Trigger: 2 matching reports
Result: Event terminated immediately
24-hour restriction on new events
Level 3 — Emergency Violations
Trigger: 1 valid report
Result: Immediate shutdown
72-hour suspension; possible permanent account action
Terminated events may be reviewed by Peacemakers via TOS §7 for validation, reversal, or additional sanctions.
Fisheez does not pre-screen or monitor streams in real time and assumes no liability for user-generated content.
14.8 Enforcement
Violations of this section may result in temporary suspension, removal of Live Event privileges, or account termination.
Severe violations (fraud, exploitation, hate content, or illegal acts) may be referred to law enforcement.
Enforcement follows a Hybrid model — user flagging → moderator review → optional Peacemaker appeal.

14.10 Purpose
This policy ensures that all Live Events on Fisheez — from auctions and tutorials to performances and community shows — operate lawfully, transparently, and safely.
It protects hosts, viewers, and the Platform by defining acceptable conduct, content rights, and enforcement processes while preserving Fisheez’s role as a neutral, non-custodial marketplace facilitator.
