§6 User Conduct

6.1 General Standards
Users agree to act honestly, lawfully, and respectfully when using the Fisheez Platform.
Fisheez PBC provides a neutral, non-custodial marketplace and does not verify or guarantee the conduct of any user.
Each user is solely responsible for the accuracy, legality, and performance of their listings, communications, and transactions.
6.2 Prohibited Items and Content
The following may not be listed, promoted, or exchanged on the Platform:
- Adult or pornographic material, sexual services, or any sexualized depiction of minors;
- Firearms, ammunition, explosives, or weaponized devices;
- Illegal drugs or controlled substances;
- Drug paraphernalia marketed for illegal use (items intended for lawful tobacco or herbal use may be permitted if described accordingly);
- Counterfeit, stolen, or infringing goods;
- Content or items that promote, glorify, or profit from hate, threats, or violence, as determined under the Platform’s public-benefit mission and community standards;
- Any product or service that violates U.S. federal, state, or local law.
Listings found to violate these restrictions may be removed and the associated accounts subject to review.
6.3 Listing Accuracy and Condition Disclosure
Sellers must select an accurate condition category (new, used, refurbished, etc.) and describe their items or services truthfully.
Misleading titles, deceptive claims, or omitted defects are prohibited.
Buyers may file a dispute within the escrow window if a listing is inaccurate or fraudulent.
Fisheez PBC encourages all parties to capture photos or video evidence before shipment and upon delivery to support potential disputes.
Such evidence does not create a legal warranty but improves transparency for Peacemaker review.
6.4 Communications and Evidence
Only messages, images, or videos exchanged through the Platform are automatically recorded for inclusion in the Dispute Resolution system.
Users may communicate elsewhere, but off-platform evidence must be uploaded during the rebuttal window to be considered.
Fisheez PBC does not monitor or store external communications and assumes no responsibility for them.
6.5 Fraud, Scams, and Manipulation
Users may not:
- Impersonate others or falsify identity information;
- Manipulate ratings, feedback, or listings;
- Circumvent fees or escrow processes;
- Submit false evidence or fraudulent payment claims; or
- Interfere with another user’s ability to transact fairly.
Violations may result in suspension or permanent loss of access under § 9.3.
6.6 Sanctions and Illegal Use
Fisheez PBC complies with all applicable U.S. laws, including OFAC sanctions and export controls.
Users may not employ the Platform for laundering, terrorist financing, sanctioned-country activity, or any unlawful transaction.
Accounts linked to restricted jurisdictions may be limited or disabled without notice.
6.7 User-Generated Content
Users retain ownership of the photos, videos, and text they upload but grant Fisheez PBC a limited, royalty-free license to display that material within the Platform for transactional and promotional purposes.
Fisheez may remove any content deemed unlawful, abusive, or inconsistent with its public-benefit purpose.
6.8 Fair Dealing and Community Behavior
Users must treat others respectfully and avoid harassment, intimidation, or discriminatory conduct.
The Platform may issue warnings or restrict accounts that undermine community trust or safety.
6.9 Security and Technical Misuse
Users may not access accounts other than their own, introduce malware or scraping tools, or exploit vulnerabilities in the Platform.
Any attempt to compromise security may result in permanent suspension and referral to authorities.
6.10 Enforcement and Reporting
Fisheez PBC may remove listings, restrict posting privileges, or suspend accounts engaged in fraudulent, illegal, or abusive conduct.
Fisheez PBC does not have direct control over Smart Shell Escrow funds; only the Buyer or Seller may initiate a dispute that pauses the escrow timer.
Users can report violations through in-app tools or official channels.
Repeated or severe violations may lead to loss of Platform access, forfeiture of NFTs linked to account privileges, or referral to law enforcement.
6.11 Flagging and Community Review System
Any verified user may flag a listing, message, or review believed to violate these Terms.
Flag categories include Illegal Content, Hate Speech, Graphic Media, Fraud, Copyright, and Other.
- Illegal content is hidden immediately pending review.
- Hate or graphic content is blurred and marked “Under Review.”
- Accuracy or fraud flags remain visible with a community-note banner.
Flagged items enter a Peacemaker Review Queue, where a minimum of three (3) Peacemakers evaluate the report and vote to:
- ✅ keep the content,
- ⚠️ require edits or blurring, or
- 🚫 remove it.
The Seller or content creator has 24 hours to respond or edit before voting closes.
Peacemakers are disqualified from reviewing any content or dispute in which they are the Buyer, Seller, Promoter, content creator, or otherwise conflicted.
Each valid moderation vote earns the Peacemaker three (3) Pearls, subject to a daily limit of ten (10) moderation votes per user.
Participation and conduct in moderation are governed by the Peacemaker Governance & Charter, which is incorporated by reference.
Users whose content is removed may appeal once to a new Peacemaker panel; that decision is final unless required by law.
All flagging and resolution data are logged for transparency.
6.12 Promoter Use of Seller Content
Promoters may access and share Seller listings only through authorized Platform tools and approved share links.
Use of Seller media, descriptions, or brand materials is limited to promotional activity that links directly to the original Fisheez listing.
Promoters may not:
- modify Seller images or trademarks,
- use Seller content for independent advertising,
- collect or reuse Seller data outside the Platform, or
- imply endorsement or affiliation without the Seller’s consent.
Fisheez PBC may suspend any account that misuses Seller materials or violates this policy.
