§15 Fisheez Universal Enforcement Policy

15.1 Purpose
The Fisheez Universal Enforcement Policy defines how moderation, compliance, and enforcement are applied across all listings, services, and live events.
It clarifies that Fisheez operates as a neutral marketplace and escrow facilitator, not as a regulator, intermediary, or law-enforcement entity.
All enforcement actions are discretionary, good-faith, and limited to protecting users and marketplace integrity.
15.2 Scope
This policy applies to all user activity on the Platform, including but not limited to:

goods and digital-item listings;

service listings and local/off-platform work conducted through Smart Shell escrow;

live events and streaming commerce;
-
promotions, giveaways, advertising, and affiliate activities; and any other user-generated content, media, or communication hosted on Fisheez.
15.3 Core Enforcement Principles
Neutral Platform
Fisheez provides infrastructure for peer-to-peer transactions and smart-contract escrow. It is not a broker, agent, or guarantor of user performance.
No Continuous Monitoring

Fisheez does not pre-screen or actively monitor every listing, stream, or communication.

Users remain solely responsible for ensuring compliance with laws and platform rules.
Discretionary Action
Fisheez may, at its discretion:

review, restrict, remove, or suspend any listing, service, live event, or account that appears to violate laws, Terms, or community standards;

temporarily pause, mute, or disable live events pending review of credible reports;

request documentation to verify identity, licensure, or listing legitimacy; and

Enforcement actions may also be triggered automatically when the required number of matching user reports is met, consistent with Live Event Moderation Rules (§14.7).

Refer serious or repeated violations to appropriate regulators or law-enforcement authorities.
Community Participation
Users may flag or report suspected violations.
- Reported matters may be escalated to the Peacemaker System (§7) for neutral review, final determination, and possible suspension or reinstatement of live-event privileges.
Good-Faith Moderation

All moderation decisions are made in good faith to protect users, deter fraud, and uphold fair commerce.

Enforcement outcomes are final unless successfully appealed through the dispute-resolution process.
No Duty to Monitor or Act
- Nothing in this policy imposes a continuing obligation on Fisheez to monitor, investigate, or respond to every report, listing, or communication.
Hybrid Enforcement Model
- Enforcement combines administrative review (for urgent or high-risk cases) and community oversight (via the Peacemaker System), balancing transparency with efficiency.
Integration by Reference
- This Universal Enforcement Policy is incorporated into the Fisheez Terms of Service and applies to all Category-Specific Provisions under §10.
15.4 Legal Foundation
This policy is supported by:
47 U.S.C. §230 – Communications Decency Act (safe-harbor for platform moderation);
FTC Act §5 – Unfair or deceptive practices;
U.S. E-Commerce and Consumer Protection Standards; and
applicable state laws governing online marketplaces and user-generated content.
15.5 Acknowledgment
By using the Platform, all users acknowledge that:
Fisheez exercises limited, discretionary moderation in good faith;
enforcement decisions do not imply ongoing monitoring; and
Fisheez’s neutral role preserves liability protections under Section 230 and related safe-harbor laws.
