§2 Eligibility and Accounts

2.1 Eligibility to Use Fisheez
Fisheez is operated by Fisheez PBC, a Delaware Public Benefit Corporation.
Access to the Platform is currently limited to individuals and businesses located within the United States.
By creating an account or using the Platform, you represent and warrant that you:
- Are at least 18 years old and legally capable of entering into binding contracts;
- Are a resident of the United States and not located in a jurisdiction where the use of the Platform is restricted or prohibited by law;
- Are not subject to any U.S. sanctions, trade restrictions, or export-control prohibitions; and
- Will use the Platform only for lawful purposes consistent with these Terms.
Fisheez PBC may, at its discretion, restrict access or functionality to specific regions or users as required by compliance, tax, or regulatory considerations.
2.2 Account Creation and Identification
Users must create an account by providing a valid email address and password, and by maintaining accurate, current contact information (email and mobile phone number).
Wallet connection through services such as MetaMask, Coinbase Wallet, or other compatible providers is also required for interaction with blockchain features including escrow, payments, and NFT ownership.
Each account is personal to the user or registered business entity. Users are responsible for maintaining the confidentiality of their credentials and for all activities that occur under their account or connected wallet.
Users must promptly notify Fisheez PBC of any suspected unauthorized access or security breach.
2.3 NFT Access Structure
All users are issued a Shorefront NFT, which functions as their verified membership credential on the Platform.
- Buyers receive a base-tier Shorefront NFT automatically and at no cost when registering.
- Sellers and service providers must complete identity verification (KYC/KYB) before activating or upgrading their Shorefront NFT for listing privileges and payment release.
- Peacemakers must complete identity verification and pass the required certification test before participating in dispute resolution.
The Shorefront NFT represents access and reputation status only. It does not grant equity, governance, or voting rights in Fisheez PBC or any affiliate.
2.4 Identity Verification (KYC/KYB)
To comply with U.S. laws and platform safety standards:
- Sellers and service providers must complete Know Your Customer (KYC) or Know Your Business (KYB) verification before publishing listings, receiving funds, or transferring escrowed payments.
- Buyers may be required to complete KYC verification before exceeding defined transaction thresholds or when required for tax or anti-fraud compliance.
- Peacemakers must maintain verified identity status at all times.
Fisheez PBC partners with third-party providers to conduct these verifications in compliance with privacy and data-protection laws.
2.5 Account Conduct and Termination
Users agree to maintain accurate information, follow community standards, and comply with all applicable laws.
Fisheez PBC reserves the right to suspend, limit, or permanently terminate any account or NFT access credential if it determines, at its sole discretion, that the user:
- Engaged in fraud, theft, or deceptive practices;
- Violated these Terms or other published policies;
- Submitted false or misleading identity information; or
- Misused the Platform, dispute system, or communication channels.
Accounts terminated for cause may lose access to listings, balances, NFTs, and reputation history without refund or restoration.
2.6 Communication and Notifications
By creating an account, users consent to receive communications from Fisheez PBC via email, text message, or in-platform notifications for security verification, account updates, and transaction notices.
Users are responsible for maintaining accurate contact information.
2.7 Public Benefit and Community Input
Fisheez PBC operates as a Public Benefit Corporation committed to fair trade, community inclusion, and transparent dispute resolution.
While users hold no formal governance rights, Fisheez may periodically solicit community feedback, votes, or surveys to guide product and policy decisions.
Participation in such programs is voluntary and does not constitute shareholder or governance authority.
