Fisheez Classifieds – Terms of Use
These Classifieds Terms of Use (“Classifieds Terms”) govern your use of the Fisheez Classifieds feature (“Classifieds”). Classifieds are distinct from the Fisheez marketplace and escrow-based transaction systems and operate under separate rules.
By posting, browsing, responding to, or otherwise using Classifieds, you agree to these Classifieds Terms.
If you do not agree, do not use Classifieds.
1. What Classifieds Are (and Are Not)
1.1 Bulletin Board Only
Fisheez Classifieds function solely as a listing and discovery service. The platform enables users to post and view advertisements, including but not limited to:
- Jobs and hiring opportunities
- Services
- Local goods
- Community notices
- Requests and offers
Fisheez does not participate in, facilitate, process, guarantee, or oversee any transaction arising from a Classifieds listing.
1.2 No Payments, No Escrow, No Custody
Unless users independently choose to use a separate Fisheez escrow product (where available and explicitly opted into), all interactions and transactions resulting from Classifieds occur entirely off-platform.
Fisheez does not:
- Handle or transmit payments
- Hold funds
- Act as an escrow agent
- Provide refunds
- Mediate disputes
- Enforce agreements between users
All negotiations, payments, delivery, and performance occur directly between users.
2. User Responsibility & Risk
2.1 Independent Transactions
You are solely responsible for:
- Evaluating listings
- Verifying the identity, legitimacy, and reliability of other users
- Negotiating terms
- Completing any transaction
- Complying with applicable laws
Fisheez makes no representations or warranties regarding listings or users.
2.2 No Dispute Resolution
Fisheez does not resolve disputes related to Classifieds.
Any disagreement, claim, loss, or harm arising from a Classifieds interaction is strictly between the users involved.
3. Posting Rules
3.1 Accuracy & Honesty
All listings must be:
- Truthful and non-misleading
- Clearly described
- Posted in the appropriate category
You may not misrepresent goods, services, qualifications, pricing, or intent.
3.2 Prohibited Content
You may not post:
- Illegal goods or services
- Fraudulent, deceptive, or scam listings
- Adult services where prohibited by law
- Hate speech, harassment, or threats
- Content that violates intellectual property rights
Fisheez reserves the right to remove listings that violate these rules or applicable law.
4. Posting Fees & Free Posting Options
4.1 Posting Fees
Certain Classifieds categories may require a flat posting fee (currently starting at $5 per listing).
Posting fees:
- Apply only to the act of posting
- Do not guarantee visibility, responses, or success
- Do not make Fisheez a party to any transaction
- Are generally non-refundable, except where required by law
4.2 Free Posting with Trusted Link
In some categories, Fisheez may allow free posting if the poster provides a verified or trusted external link (such as a social profile or website) as part of the listing.
Fisheez does not verify or endorse external links and assumes no responsibility for off-platform interactions.
5. Messaging & Contact Between Users
5.1 Platform Messaging
Sellers may choose to communicate with buyers using Fisheez’s internal messaging system.
Buyers who wish to contact a seller through platform messaging may be required to:
- Provide an email address
- Complete email verification
Email-verified users may be granted limited, listing-specific messaging access without creating a full account.
5.2 No Guarantee or Monitoring
Fisheez:
- Does not monitor message content for accuracy or intent
- Does not guarantee delivery, response, or outcomes
- Is not responsible for communications between users
All messaging remains user-to-user and occurs at the users’ own risk.
6. Optional Escrow (If Offered)
In limited cases, users may choose to use a separate Fisheez escrow service.
If and only if:
- Both parties explicitly opt in, and
- The interaction is converted into an escrow-enabled flow
Then that transaction is governed entirely by the SmartShell Escrow Agreement, not these Classifieds Terms.
Fisheez has no obligation to offer escrow for Classifieds.
7. No Employment Relationship
Job listings and hiring interactions through Classifieds:
- Do not create any employment, agency, or contractor relationship with Fisheez
- Are solely between the posting party and the applicant
Fisheez does not vet employers, job seekers, or workplace conditions.
8. Content License
By posting content to Classifieds, you grant Fisheez a non-exclusive, worldwide, royalty-free license to host, display, distribute, and promote your listing in connection with the Classifieds service.
9. Moderation & Enforcement
Fisheez may:
- Remove listings
- Limit posting privileges
- Suspend or terminate accounts
If a user is believed to be engaging in fraud, abuse, or violations of these terms or the law.
Fisheez is not obligated to monitor Classifieds and does not guarantee removal of harmful content.
10. Disclaimer of Warranties
Classifieds are provided “as is” and “as available.”
Fisheez disclaims all warranties, including:
- Accuracy of listings
- User conduct
- Safety of transactions
- Outcomes of interactions
Use Classifieds at your own risk.
11. Limitation of Liability
To the maximum extent permitted by law, Fisheez is not liable for:
- Losses, damages, or disputes between users
- Fraud, theft, or misrepresentation
- Personal injury or property damage
- Lost profits or opportunities
12. Governing Terms
These Classifieds Terms supplement the Fisheez Terms of Service.
If there is a conflict:
- These Classifieds Terms control for Classifieds use
- The general Terms of Service apply otherwise
13. Acceptance
By using Fisheez Classifieds, you confirm that:
- You understand Fisheez is not a party to Classifieds transactions
- You assume all risk related to interactions and deals
- You agree to these Classifieds Terms
