§8 Intellectual Property

8.1 Platform Ownership
All technology, source code, smart-contract logic, trade names, trademarks, service marks, logos, designs, databases, and documentation comprising the Fisheez Platform (collectively, the “Fisheez Materials”) are owned or licensed by Fisheez PBC and protected by U.S. and international copyright, trademark, and trade-secret laws.
Except as expressly authorized in these Terms, no license or right is granted to use any Fisheez Materials for commercial or derivative purposes.
8.2 User-Generated Content
Users retain ownership of the images, videos, text, audio, or other materials they upload (“User Content”).
By posting or transmitting User Content on the Platform, each user grants Fisheez PBC a non-exclusive, worldwide, royalty-free, sublicensable, transferable license to:
- host, display, reproduce, adapt, and distribute the content within the Platform and related marketing or social-media channels, and
- store and back up such material for operational and legal purposes.
This license exists solely to operate, promote, and improve the Platform and ends when the content is deleted or the account is closed, except as required for dispute or legal record retention.
8.3 Listing Media and NFT Licensing
- Sellers are responsible for ensuring they have legal rights to any media, logos, or marks used in listings or NFT artwork.
- Uploading copyrighted material without permission is prohibited.
- When NFTs are minted or sold through Fisheez, the NFT represents proof of ownership of the tokenized record, not ownership of Fisheez code, trademarks, or brand assets.
- The creator of an NFT collection (for example, Tide Turners) retains copyright in the underlying artwork unless otherwise stated in that collection’s separate license terms.
Unless a different license is specified on the NFT collection page, each NFT purchase includes a personal, non-commercial, worldwide license to display, resell, or trade that token and its associated artwork within Fisheez or compatible marketplaces.
8.4 Use of Fisheez Name and Brand Assets
No user may use the “Fisheez” name, logo, trade dress, or related marks without prior written consent.
Authorized partners and promoters may use approved logos or badges provided by Fisheez PBC under specific brand-usage guidelines.
All goodwill arising from authorized use accrues solely to Fisheez PBC.
8.5 AI-Generated or Automated Content
Where AI tools integrated in the Platform assist in creating listing text, artwork, or other material:
- The user initiating the generation remains responsible for compliance with applicable IP laws.
- Fisheez PBC makes no warranty that generated outputs are free of third-party rights.
- Fisheez PBC retains limited rights to display or archive AI-generated material when it forms part of Platform listings or marketing examples.
8.6 Claims of Infringement (DMCA Notice)
Fisheez PBC complies with the U.S. Digital Millennium Copyright Act (17 U.S.C. § 512).
Rights holders may submit takedown notices to:

A valid notice must include:
- Identification of the copyrighted work claimed to be infringed,
- Identification of the material to be removed,
- Contact information of the complainant,
- A statement of good-faith belief that the use is not authorized, and
- A statement under penalty of perjury that the information is accurate and the sender is authorized to act.
Fisheez may remove or disable access to the material and, when appropriate, terminate repeat offenders under § 6.5.
Counter-Notice:
If you believe your material was removed or disabled in error, you may submit a counter-notice to the same Copyright Agent including:
(a) identification of the material and its location before removal;
(b) a statement under penalty of perjury that you have a good-faith belief the material was removed by mistake or misidentification;
(c) your name, address, telephone number, and consent to jurisdiction of the Federal District Court in Delaware (or your local judicial district, if outside the U.S.); and
(d) your physical or electronic signature.
Upon receipt of a valid counter-notice, Fisheez may restore the content in accordance with the DMCA, unless the copyright owner files a court action.
8.7 Feedback and Suggestions
Users may voluntarily provide ideas, feedback, or proposals.
By submitting feedback, the user grants Fisheez PBC a perpetual, worldwide, irrevocable, royalty-free license to use and implement such feedback without obligation or compensation.
8.8 Reservation of Rights
All rights not expressly granted in these Terms are reserved by Fisheez PBC.
Unauthorized reproduction, reverse engineering, or commercial exploitation of the Platform is strictly prohibited.
Nothing in this section obligates Fisheez PBC to monitor or mediate copyright disputes. Fisheez’s role is limited to processing valid DMCA notices under 17 U.S.C. §512.
